GENERAL CONDITIONS - FOREVER 88 S.L.

1. FIELD

1.1. These General Terms and Conditions, together with any Special Conditions that may be established, regulate the relationship between Forever 88 S.L., with registered office at C/ Industria 573-579, Nave - 08918 Badalona (Barcelona), and third parties (hereinafter, the "Users") using the portal [indicar dominio] (hereinafter, the "Portal"), as well as with third parties that contract the products or services accessible through the Portal (hereinafter, the "Products and Services").

1.2. The purchase of certain Products or Services may be subject to Special Conditions, which shall prevail over these General Conditions in case of discrepancy.

1.3. By placing an order or contracting a service, the User expressly accepts these Terms and Conditions, which will govern all commercial relations between the User and Forever 88 S.L.

1.4. Forever 88 S.L. may modify at any time these General Conditions or the applicable Special Conditions. Such modifications will be published on the Portal for the User's knowledge. The use of the Portal after the modification implies its acceptance.

2. ACCESS TO PRODUCTS AND SERVICES

2.1. For the use of certain services, Forever 88 S.L. may require the User to register. The data provided will be treated in accordance with the Privacy Policy.

2.2. The password assigned to the User is personal and non-transferable. The User undertakes to keep it with diligence. Forever 88 S.L. may change passwords with prior notice.

2.3. Forever 88 S.L. may add, modify or delete Products and Services available on the Portal at any time and without prior notice.

2.4. Forever 88 S.L. may unilaterally modify the presentation and configuration of the Portal.

3. USER OBLIGATIONS

3.1. The User agrees to use the Portal and the Products and Services in accordance with the law, good faith and these General Conditions.

3.2. The User undertakes, among other things, to:

(a) Provide truthful and updated data.
(b) Not to disseminate illegal or offensive content or content that violates fundamental rights.
(c) Not introduce viruses, malware or elements that damage systems.
(d) Not to engage in unauthorized advertising.
(e) No impersonation.
(f) Not to intercept communications.
(g) Not to modify or damage Forever 88 information S.L. or third parties.
(h) Not to disseminate protected content without authorization.
(i) Not to use the information obtained in the Portal for unauthorized commercial purposes.

4. SALE OF PRODUCTS AND PROVISION OF SERVICES

4.1. The characteristics and prices of the Products are displayed on the screen. Prices are in Euros and are valid unless there is a manifest error.

4.2. Specifications and photographs are based on manufacturer's information. In case of clear error, Forever 88 S.L. will take back the product and reimburse the amount.

4.3. If a product is not available, another product of similar characteristics may be delivered without price increase. The User may request a refund if he/she is not satisfied.

4.4. If the User sends a device for repair, Forever 88 S.L. verify their condition. If additional faults are detected, they will be reported for further assessment.

4.5. The User must save his data by means of a backup copy. Forever 88 S.L. is not responsible for loss of data resulting from the repair.

4.6. In case of unforeseen defects, an additional quotation will be sent.

4.7. All content stored on a delivered device belongs to the User, who is solely responsible for its information.

5. PRICES AND PAYMENT TERMS

5.1. The price list in effect at the time of the order shall be binding.

5.2. Payment is understood to have been made at the time of delivery of the goods, except for home deliveries.

5.3. Available payment methods: transfer, credit/debit card and others that may be enabled by the Portal.

5.4. Forever 88 S.L. may change the methods of payment at any time.

5.5. Some payment methods may be limited to specific areas or products.

5.6. Forever 88 S.L. may withhold a payment to verify possible fraud.

6. SHIPPING AND DELIVERY CONDITIONS

6.1. Forever 88 S.L. ships through third-party carriers.

6.2. Delivery will be made to the address provided by the User. Changes or errors in the address may generate additional costs.

6.3. Delivery times vary from 24 h to 15 days depending on availability.

6.4. For orders with multiple items, all items will be shipped together according to the lead time of the item with the longest delay.

6.5. The User has 48 hours to check the order. After this period, the order is considered accepted.

6.6. The order is considered delivered when the delivery note is signed.

6.7. The products will be the property of Forever 88 S.L. until payment in full.

6.8. Shipping rates are shown on the Portal.

6.9. Forever 88 S.L. may modify rates and shipping methods without prior notice.

7. INTELLECTUAL AND INDUSTRIAL PROPERTY

7.1. All content of the Portal belongs to Forever 88 S.L. or to authorized third parties.

7.2. The User may not reproduce, modify or distribute such content without express authorization.

7.3. The User shall not remove or manipulate intellectual property notices.

8. RESPONSIBILITY

8.1. Forever 88 S.L. may suspend access to the Portal if it detects a use contrary to these conditions.

8.2. The User will be liable for damages caused to Forever 88 S.L. or third parties arising from non-compliance with the conditions.

8.3. The use of the Portal is the sole responsibility of the User.

9. COMMUNICATIONS AND CUSTOMER SERVICE

9.1. Forever 88 S.L. may communicate with the User by mail or e-mail.

9.2. The User may contact Forever 88 S.L. by mail, e-mail or Portal form.

9.3. Any change of address must be communicated between the parties.

Forever 88 S.L. may suspend or terminate the Portal service at any time. When possible, prior notice will be given.

12. RIGHT OF WITHDRAWAL

12.1. The User has 14 calendar days from receipt of the product to exercise the right of withdrawal.

12.2. The cancellation must be requested by e-mail. Forever 88 S.L. will send the corresponding form.

12.3. The consumer shall be liable for any diminished value resulting from improper use.

12.4. The right of withdrawal shall not apply to the products set out in article 103 of the TRLGDCU (customized products, sealed for hygiene, unsealed software, etc.).

12.5. Once the product is received, the amount will be refunded within 24 to 72 hours depending on the method of payment.
